出卖人应当保证房屋没有产权纠纷,未被限制转让。出卖人承诺其配偶和该房屋的共有权人均知晓并同意本次房屋交易,认可本合同及其他相关文件的约定,且无他人对该房屋享有优先购买权;买受人承诺其配偶和该房屋的共同买受人均知晓并同意本次房屋交易,且认可本合同及其他相关文件的约定。如因一方违反前述承诺,导致该房屋不能办理的产权登记或发生债权债务纠纷的,由违反承诺方按照房屋成交总价款的20%赔偿守约方的损失。
The Seller shall guarantee that the Housing is neither involved in any property ownership dispute nor restrained for transfer. The Seller promises that his/her spouse and the co-owner of the Housing have known and agreed on the housing transaction, and recognized the agreements provided in the Contract and other relevant documents, and that no other party has the right of preemption for the housing. The Buyer promises that his/her spouse and the co-buyer of the Housing have known and agreed on the housing transaction, and recognized the agreements provided in the Contract and other relevant documents. If property ownership registration of the Housing is impeded or any debtor or creditor dispute arises due to failure of any party to fulfill the aforesaid promises, the defaulting party shall compensate for the losses of the non-defaulting party by paying 20% of the total housing transaction price.
